Terms and Conditions of Pre-Sale:

1. The potential customer unconditionally accepts and is aware that the legal, civil, economic, and fiscal relationship arising from the purchase of this product is to be considered between the "private buyer" and the "producing/distributing company of the product."
2. The potential customer is fully informed and aware that Clickoggi, from an economic, legal, fiscal, and juridical standpoint, is solely an external company operating in the online marketing sector. Based on its corporate purpose, Clickoggi may choose to manage "the execution of advertising campaigns" for goods or services produced, distributed, or marketed by producing/distributing/commercial companies that opt to promote their products/services through affiliation networks, to which Clickoggi may be temporarily affiliated. In other words, Clickoggi selects products/services available in various affiliation networks, studies their brand, and implements, at its own expense and discretion, an online marketing strategy utilizing various channels provided by the internet (e.g., e-commerce, eBay, social networks, etc.). The purpose is to generate useful contacts (potential customers/leads) who show interest in the products/services and to connect these potential customers with the producing/distributing/commercial companies that own the products/services, transferring data and any payments through specific contact forms provided by the affiliation network. This network offers, without obligation, the opportunity for the external affiliate Clickoggi to create and manage advertising campaigns at its own expense and discretion.
3. The potential customer unconditionally accepts that the data provided after clicking the "purchase" button may be used by Clickoggi exclusively to transfer it to the producing/distributing/commercial companies through specific contact forms provided by the affiliation network, which offers, without obligation, the opportunity for the external affiliate Clickoggi to create and manage advertising campaigns at its own expense and discretion. Additionally, the potential customer agrees to receive future communications from Clickoggi regarding new commercial offers related to this product.
4. Pre-order:
   1. The potential customer unconditionally accepts that by clicking the "purchase" button or adding a product to the cart, they are simply placing a pre-order with an entity responsible for conducting advertising campaigns, not with a merchant or the actual producer/distributor of the product. This is because: due to the nature of the product, the potential customer may be contacted by the actual producer/distributor to verify their ability to use the product. Only then will a commercial transaction be finalized between the consumer/potential customer and the producing/distributing company, transitioning the potential customer to an actual customer, and the order will become effective.
   2. Clickoggi is not a merchant, does not own the product, does not physically possess it, and does not import, ship, or market the item in this advertisement in any way. Only when the customer’s data is received and used by the producing/distributing company, and provided the necessary conditions are met (confirmation of the pre-order by the customer), will a commercial transaction be finalized, transitioning the potential customer to a customer of the producing/distributing company, and the order will become effective.
5. Guarantees:
   1. Clickoggi guarantees that it will handle the potential customer’s data and any payments with the diligence of a prudent person from the moment the pre-order is placed until the data is effectively transferred to the producing/distributing company.
   2. Although Clickoggi is a marketing company and not a merchant or producer/distributor of the product and has activated the advertisement solely to generate a potential customer (not a buyer) and thus a useful contact, not a commercial transaction, Clickoggi guarantees the potential customer, to the extent possible, assistance with any issues arising with the producer/distributor. This assistance will be provided by facilitating interactions between the potential customer and the company for returns and refunds as required by applicable regulations, without any legal, juridical, fiscal, or commercial obligation to do so.
6. This advertisement is directed exclusively to private individuals, not companies. Clickoggi has no financial or economic relationships with the producing/distributing companies, only with the affiliation network that provides the offer on which the advertising campaign is built. Consequently, invoicing requests from companies can only be addressed to the producing/distributing companies during the confirmation call, based on their fiscal policies, and not to Clickoggi. Due to the nature of the pre-order, Clickoggi is not guaranteed compensation for each contact generated but receives non-detailed payments exclusively from the affiliation network through which it connects the potential customer and the producing/distributing company.
7. Clickoggi does not guarantee that the products are shipped from warehouses located in Italy or San Marino or that shipping is handled by specific couriers. It only guarantees that shipping complies with delivery times once the potential customer confirms the pre-order with the producer/distributor and a commercial transaction is effectively concluded between the two parties.
8. The potential customer unconditionally accepts that Clickoggi is not fiscally, juridically, legally, or civilly responsible for any disputes or issues of any nature arising from the confirmation of the order or the use of the product marketed by the producing/distributing company in this advertisement. For any disputes, refer to the producer/distributor, whose company details are always provided on the product packaging.
9. The potential customer unconditionally accepts that Clickoggi is only required to issue refunds for purchases made through the PayPal payment system, and only in cases where the distributor/producer of the product receives a return request within the terms and conditions provided by law, and only for sealed products. No refunds will be issued for unsealed products.
10. Clickoggi does not guarantee the accuracy of the information provided by the affiliation network or the distributing/producing companies, nor does it guarantee their compliance with applicable regulations, as it has no obligation, as a marketing agency, to verify anything related to the advertised product. In this regard, the potential customer unconditionally accepts that, for this product, the image is provided from the producer/distributor’s catalog, and the packaging may differ in minor details, as the producer/distributor reserves the right to modify such details at its sole discretion. Additionally, as producers are constantly working to improve their products, the potential customer accepts that the product’s content may differ from the description due to improvements in concentration or ingredients by the producer. Information regarding such conformity can be obtained during the confirmation call.
11. The potential customer accepts that the primary payment method for this product is cash on delivery (payment upon receipt), which will occur only after telephone confirmation and receipt of the product from the producer/distributor. If the potential customer chooses another payment method, Clickoggi may choose to immediately refund the customer and proceed with transferring the pre-order data to the distributor/producer, who will, upon confirmation of the purchase, ship the goods via cash on delivery. Alternatively, without creating any commercial obligation, Clickoggi may collect the payment and transfer it along with the data to the distributor/producer through the contact forms provided by the affiliation network.
12. Clickoggi is not responsible for statements made by any other online company, on any external or internal webpage of its e-commerce platform, regarding the product subject to this advertising campaign.
13. This advertisement does NOT guarantee anything, does NOT promise anything miraculous, and does NOT use deceptive tactics to encourage the user to pre-order the product by exploiting needs or discomforts of any nature. By clicking the "purchase" button and pre-ordering the product in this advertisement, the potential customer is aware of their desire to be contacted by the distributor/producer to purchase the product after telephone confirmation, not by Clickoggi, of their own free will, without any guarantee of results and without the fraudulent "satisfaction or refund" guarantee commonly found elsewhere. Furthermore, Clickoggi advises the potential customer to proceed with the pre-order ONLY if they are certain, following medical advice, that they can come into contact with the product and that its ingredients may actually provide benefits. In addition to medical advice, it is recommended to address any doubts, conditions, or disorders with the commercial/distributing/producing company during the pre-order confirmation call.
14. The purchase of the product by minors is prohibited. Purchases made by minors can generally be declared void, as individuals under 18 lack the capacity to act. This entitles parents to request a refund of the amount spent, voiding the consequences of the distance contract. However, this principle does not apply if the minor has concealed or falsified their age through deceptive behavior or by claiming to be of legal age when registering on this site.
15. Pursuant to Article 52 of Legislative Decree 206/2005 and subsequent amendments and integrations, except for the exceptions provided in Article 59 of the same decree, the consumer has a period of fourteen days to withdraw from a distance or off-premises contract without providing any reason and without incurring costs other than those specified in Article 56, paragraph 2, and Article 57. Due to the nature of the pre-order, this right begins and is calculated from the day the product is received at the customer’s home.
16. Regarding shipping times, the potential customer, by accepting the nature of the pre-order when clicking the "purchase" button/adding the product to the cart and providing their data, unconditionally accepts that the operational timelines of the distributing/producing company are as follows:
    • Pre-order submitted by 2:00 PM: phone call within 2 hours, and from the telephone confirmation, 30 minutes for packaging and pickup by the courier from the distributor/producer, with delivery in 1 or 2 working days.
    • Pre-order submitted after 2:00 PM: phone call within 12 hours, and from the telephone confirmation, 30 minutes for packaging and pickup by the courier from the distributor/producer, with delivery in 1 or 2 working days.
    The potential customer thus accepts that delays may occur due to their failure to respond to the mandatory confirmation call from the distributor, and they may not hold Clickoggi liable in any way for any delays.
17. Due to the purely advertising nature of the service, any negative feedback, even in comments, regarding the product’s ineffectiveness without evidence will be reported for removal and deleted.
18. Clickoggi, the affiliation network, and the distributing/producing companies cannot be held responsible in any way for the onset of illnesses or any physical conditions described as discomfort or otherwise negative to health. This is because, as stated in point 13 of these terms and conditions, the potential customer is advised BEFORE placing the pre-order to consult their primary care physician or specialist to determine with certainty whether their physical condition allows them to use or come into contact with the product in any way without health risks. The potential buyer is not only informed to be more aware of the risks associated with contact with the product in their specific case but is also encouraged in multiple parts of the description NOT to provide their data without prior certified medical advice prohibiting its use.
19. No term used in any online platform by the platform’s staff, for any reason, can be interpreted to alter Clickoggi’s corporate nature. For example, if the e-commerce platform or other platforms identify Clickoggi as the seller, this does not mean that Clickoggi is actually a company with a commercial purpose or that it proposes advertisements to sell or create a direct commercial transaction between itself and a potential customer.
    By making a purchase and thus a payment, you accept every word of the above.

Retention Period
